1. Acceptance of Terms

By accessing or using NyayaSetu ("Platform", "we", "us"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Platform. These terms apply to all visitors, registered users, lawyers, chartered accountants, company secretaries, and other professionals listed on the Platform.

2. Nature of the Platform

NyayaSetu is a technology marketplace that connects clients with independent legal and compliance professionals. NyayaSetu itself is not a law firm and does not provide legal advice. All professional services are rendered solely by the independent professionals listed on the Platform. Any engagement between a client and a professional is a direct contract between those parties.

In accordance with Rule 36 of the Bar Council of India Rules, lawyers listed on this Platform do not directly advertise their services; the Platform operates as a neutral directory under the framework of the Information Technology Act, 2000.

3. Eligibility

You must be at least 18 years of age and legally competent to enter into contracts under the Indian Contract Act, 1872 to use the Platform. By registering, you represent that you meet these requirements.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use. NyayaSetu reserves the right to terminate accounts that violate these Terms.

5. Prohibited Conduct

  • Impersonating any person or entity, or misrepresenting your affiliation.
  • Using the Platform for any unlawful purpose or in violation of any applicable law.
  • Uploading false, misleading, defamatory, or fraudulent content.
  • Attempting to gain unauthorised access to the Platform or its systems.
  • Scraping, crawling, or automated data extraction without prior written consent.
  • Posting or transmitting any content that infringes third-party intellectual property rights.

6. Payments & Refunds

Payments are processed through Razorpay in accordance with RBI guidelines. Service fees and platform commissions are disclosed at checkout. Refund requests are governed by our Refund Policy available at nyayasetu.in/refund. Chargebacks initiated without following the refund process may result in account suspension.

7. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is owned by NyayaSetu Technologies Pvt. Ltd. or its licensors and is protected under applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.

8. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. NyayaSetu makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content or professional service. We do not guarantee uninterrupted or error-free operation of the Platform.

9. Limitation of Liability

To the fullest extent permitted by law, NyayaSetu shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform or any professional service obtained through it. Our aggregate liability shall not exceed the amount paid by you in the three months preceding the claim.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka. Prior to litigation, parties agree to attempt resolution through mediation as per the Mediation Act, 2023.

11. Amendments

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. Material changes will be communicated via email or an in-app notice.
